Terms & Conditions

Our Terms and Conditions are listed below for your information. Signing up to receive any service from The Sustainable Cleaning Co. Ltd is an acknowledgement that you understand and agree to the following:

1. Our services

TSCC (“The Sustainable Cleaning Co. Ltd”) provides cleaning services on a regular or casual basis for homes or workspaces by members of the TSCC team. We act as an intermediary between you (the client) and the cleaner (the contractor). We will match you to a cleaner and arrange the collection and disbursement of payments for the services.

2. The cleaning team

Our crew are independent contractors and not agents or employees of TSCC. Each cleaner will go through a screening process before joining our team, which may include interviews, criminal conviction and reference checks. As part of their contract terms, the cleaners are to provide a consistently high standard of service, good attitude, and reasonable duty of care.

3. The cleaning services

The cleaner will provide the cleaning services as set out in a service form made available to the client on their agreement to receive services. The service form will include the day and time, frequency and which cleaning services are required. Should you request any additional services in the future, you must inform us with reasonable notice. Every reasonable effort will be made to fulfill your special requirements.

4. Our cleaning products

We are a company that is passionate about reducing plastics and chemicals in homes and small workspaces. We currently choose to use the world’s leading microfibre brand from Norway (norwexbiz.nz) and our cleaners will use these products as supplied by us when carrying out the majority of cleaning services. In engaging in our services, you agree to the use of Norwex for the cleaning of your home or workspace. In the event that you require other products to be used by the cleaner, you must first notify us so that we can inform the cleaner. You will also be required to supply the other product. This clause does not prevent us from partnering with another sustainable range of cleaning products in the future if we deem it more suitable. We will notify you of any changes in cleaning products.

5. Fees

You will be charged an hourly cleaning fee as set out in the attached client service form (excluding GST). Any additional services requested and agreed to will be paid at a negotiated hourly rate.

6. Payment for services

TSCC agrees to act as agent for the cleaner in collecting payment from you and disbursing this to the cleaner’s bank account after the deduction of charges and withholding taxes imposed on independent contractors under the Income Tax Act 2007. We will invoice you fortnightly for the cleaning services, unless otherwise agreed. This invoice is made up of the regular days and hours stated in your service form as well as any additional services agreed to. Payment is required within 7 days of issue of the invoice. Overdue accounts will include a penalty interest of 25% per month. If referred to a collection agency, additional costs will be incurred at your cost.

7. Exclusivity

The cleaners are contractually obliged not to arrange cleaning services directly with clients. Please direct all cleaning services through TSCC. You will be liable to pay TSCC a one off ‘finder’s fee’ of $500.00 (excluding GST) in any case that this clause is breached.

8. Warranties

While every effort is made to find cleaners who will provide a high quality of service, TSCC does not warrant any cleaner’s suitability to provide the services, including but not limited to honesty, capability or character of any cleaner.

9. Liability

TSCC makes every effort to maintain a high standard of integrity and reliability amongst the cleaners. However, TSCC cannot accept liability to you or any other person for loss or damage caused by the cleaners (whether negligent or otherwise) arising directly or indirectly from the cleaning services. Without limitation of the foregoing, in no circumstance will TSCC be liable for consequential loss or damage, loss of profits, special damages, or damages for emotional distress. To the extent that any liability is not excluded under these terms and conditions, such liability will be limited on each occasion to the fees you paid to TSCC for that service.

10. Insurance

You must have the necessary Home and Contents or Business insurance to cover any incidences of property damage including fire damage. Under no circumstances will TSCC be liable for any damage to your property as a result of the cleaner including any injury, illness or death caused by the actions of a cleaner.

11. Health and safety

TSCC will, at all times, have in place and exercise appropriate health and safety standards and policies. However, you acknowledge that you are responsible for your own health and safety. You also agree to provide the cleaners with an occupationally safe work environment.

12. Changes to services or cancellation

If you are going away and want to suspend the cleaning services you must notify us at least one week in advance. In the event that the cleaner is not available to provide the cleaning services or fails to turn up to perform the services on their scheduled day, we will attempt to reschedule the services within a reasonable period. If this is not achievable then we will use our best endeavours to find another suitable cleaner. We will give you details of the replacement cleaner and you can decide whether or not to use their services. In the event that we are unable to find a suitable replacement, we will deduct the cost of the clean from the following invoice. In the event that you cancel the cleaning service within 24 hours of the scheduled cleaning time, you will be charged a $50 (excluding GST) cancellation fee. TSCC reserves the right to cancel the services immediately should it become apparent that a cleaner is being mistreated in any way or found to be working in an unsafe or unreasonable working environment. No refund will be provided in these circumstances. In all other circumstances either party may terminate the services by providing two weeks’ notice to the other.

13. Changes to terms and conditions

TSCC reserves the right to change these terms and conditions at any time. A notice will be emailed to you with details of the changes and your continued use of the cleaning services will be deemed to constitute your acceptance of the new terms. In the event that you do not agree with the new terms and conditions, you should terminate the services by giving us notice as required in clause 12.

14. Privacy obligations

TSCC will comply with their obligations set out in the Privacy Act 1993. You acknowledge that TSCC may, for purposes relating to the cleaning services, obtain, collect, use and supply to other persons (the cleaners), as may be necessary, personal information about you and you give consent to such collection, use and supply (for example your address, telephone number and access details). The cleaners have also been advised that they must not breach the privacy of any client in the course of carrying out the cleaning services.

15. Complaints procedure

Should a dispute arise, you are encouraged to contact us immediately. We will investigate the dispute and make a decision on the issue as we consider appropriate. The following process should be followed:

1. You must outline the complaint in writing with sufficient detail and include written examples if appropriate. If a complaint is urgent, this needs to be specified.
2. Once the dispute is submitted it will be reviewed by TSCC within 4 working days of receipt. Urgent complaints will be reviewed as soon as practical.
3. TSCC may contact either party for further information as part of the investigation.
4. TSCC will make a final decision on the matter as it considers appropriate. This may include the termination or suspension of the cleaning services.
